PPA — Over the counter cough and cold medication
Beginning in November 2000, lawyers in the firm assumed a predominant role in the representation of victims suffering from catastrophic stroke injuries induced by their ingestion of the active ingredient phenylpropanolamine (PPA) found in most over-the-counter cough/cold medications and appetite suppressants.
PPA was withdrawn from the U.S. marketplace by request of the FDA on November 3, 2000, due to the hemorrhagic stroke dangers it posed to consumers. Since the removal of PPA, lawyers in our firm have reviewed thousands of PPA stroke claims. We utilize a careful and thorough screening process, with the assistance of full-time medical staff, to identify those catastrophically injured victims who meet our high selection criteria.
In February, 2001, Partner Alex MacDonald filed the first PPA lawsuits in the country since the products' removal - including the first-in-the-nation PPA wrongful death suit. Between November 2000 and June 2006 a team of lawyers lead by Alex MacDonald prosecuted approximately 30 catastrophic injury claims across the country, and consulted with and assist other plaintiff lawyers preparing their own PPA cases for trials.
The firm also played a defining leadership role in this important and complex litigation on the national stage:
In 2001, Alex MacDonald was appointed membership on the 12 lawyers Plaintiffs' Steering Committee by the federal Multi-District Litigation (MDL) court for the Eastern District of Washington overseeing the national PPA litigation. Throughout the PPA MDL, the trial team lead by Alex MacDonald offered their leadership talents to create one of the most efficient, stream-lined and productive MDLs in recent history.
From the filing of the first PPA lawsuits in the nation in February 2001, to the prosecution of the most serious stroke and death claims across the country, to the development of the medical and scientific evidence, to the highly successful resolution of cases through settlement and trial, the trial team lead by Alex MacDonald forges a new path for the plaintiffs' mass tort bar.
